Terms of Service

You must be at least 18 years old and able to form a binding contract to use Erudizio. By using the service you confirm that the information you provide is accurate and that you will keep it up to date. If you use Erudizio on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

Erudizio helps you turn an idea into a finished ebook. It guides you through planning, writing, review, cover and interior design, and delivery of a “Launch Kit” (a PDF, an editable DOCX, a cover image, and marketing copy). Parts of the service use third-party artificial-intelligence models to generate text and images based on the inputs you provide.

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at support@erudizio.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

• The unit you buy is a finished ebook, not an AI operation. Subscriptions (Starter, Pro, Studio) grant a monthly allowance of ebooks; one-time packs grant a single ebook.
• One credit is charged per ebook, once, at the moment you approve its plan — the point of commitment before the main generation work. Abandoning at the idea or plan stage is free.
• Failed generations are never charged. If a generation does not complete, you are not billed a credit for it.
• Regenerations are free to you, subject to a reasonable internal fair-use limit so the service stays sustainable for everyone. If you ever reach it, contact us and we will help.
• Monthly allowances do not roll over; one-time packs do not expire.

Payments are processed by our payment provider, Stripe. Cancellations and refunds are governed by our Refund Policy.

Subscriptions are an automatically renewing (negative-option) purchase. Before you pay, and again in your confirmation email, we disclose the following, and by subscribing you give your express consent to it:

• your subscription renews automatically at the end of each billing period (monthly or annually) until you cancel;
• the amount that will be charged and the frequency of the charge, as shown at checkout;
• you may cancel at any time, online, from the billing portal in your account — the same channel you used to subscribe, with no phone call, no email, and no retention interview required;
• cancelling stops future charges; you keep access until the end of the period you already paid for.

For annual subscriptions we send a reminder before each renewal, restating the amount, the renewal date, and how to cancel. If you ever find cancellation harder than described here, tell us at support@erudizio.com and we will cancel it for you and refund the charge.

Prices are shown at checkout in US dollars. Depending on where you are, sales tax, VAT, or an equivalent tax may be added to the price shown and will be displayed before you confirm payment. If you are a business in the EU or UK with a valid VAT identification number, you may enter it at checkout so that the reverse-charge mechanism applies where it is available. You are responsible for any taxes on your own resale of the ebooks you create.

Erudizio produces content using automated AI systems. AI output can be inaccurate, incomplete, or unsuitable for a given purpose, and may occasionally resemble existing material. You are responsible for reviewing, editing, and validating everything you generate before you publish, sell, or otherwise rely on it.

Disclosing AI use: the text, images, and coversErudizio produces are artificially generated. If you publish them, you may be legally required to say so — in the European Union, for example, transparency rules for AI-generated content apply from 2 August 2026 to material published to inform the public. We include a disclosure page in the ebooks we generate; if you remove or alter it, meeting any disclosure obligation that applies to you becomes your responsibility.

Fitness and health content: Erudizio is used to create fitness and wellness material. Nothing it generates is medical advice, and it is not a substitute for a qualified professional. You are responsible for ensuring your ebooks are safe, accurate, appropriately disclaimed, and compliant with the laws and advertising rules that apply to you and your audience.

You agree not to use Erudizio to:

• create content that is unlawful, defamatory, infringing, hateful, or that promotes harm;
• generate dangerous or misleading health, medical, or nutritional claims;
• infringe anyone’s intellectual-property, privacy, or other rights;
• attempt to reverse-engineer, disrupt, overload, or gain unauthorized access to the service or its underlying systems;
• resell, sublicense, or provide the service itself to third parties except as expressly permitted.

You retain ownership of the ideas, text, brand details, and materials you submit (“Your Content”). You grant us a limited, worldwide, non-exclusive licence to host, process, and transmit Your Content solely to operate and provide the service (including sending it to the AI and infrastructure providers described in our Privacy Policy).

We claim no ownership of the ebooks you generate and take no royalties. You are free to sell, distribute, print, translate, and use them commercially, without payment or attribution to us. To the extent we hold any rights in the output you generate, we assign them to you.

One honest caveat about copyright. Whether a given ebook is protected by copyright is a question of law, not something we can grant you. In the United States, material generated purely by an AI system, without meaningful human creative contribution, is not eligible for copyright protection — a position the Copyright Office has maintained and that the Supreme Court left standing in 2026. Your editing, selection, arrangement, and creative direction are what can make a work protectable. We therefore give you every right we have, but we do not and cannot warrant that any particular output is copyrightable or free of third-party claims.

The Erudizio platform, software, design, branding, and documentation are owned by Smartmind Innovations and its licensors and are protected by intellectual-property laws. These Terms do not grant you any right in our brand or platform beyond the right to use the service as intended.

Erudizio depends on third-party providers, currently: OpenAI (text, image, and voice-transcription models), Stripe (payments), Hetzner (application hosting, in Germany), Amazon Web Services (file storage), Resend (email delivery), and Cloudflare (DNS, CDN, and network security). Your use of the service is also subject to those providers’ terms where applicable. We are not responsible for third-party services we do not control. The current list is kept in our Privacy Policy.

We work to keep Erudizio available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. We may also enforce reasonable technical limits (for example, on plan length, images per chapter, and regeneration usage) to keep the service sustainable.

To the maximum extent permitted by law, Erudizio is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, non-infringement, and the accuracy or reliability of AI-generated content. If you are a consumer, this section does not exclude warranties that the law does not allow us to exclude.

To the maximum extent permitted by law, Smartmind Innovations will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or USD 100. Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

If you use Erudizio in the course of a business, you agree to indemnify and hold harmless Smartmind Innovations from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your ebooks, or your breach of these Terms or of applicable law. This section does not apply to consumers.

You may stop using Erudizio and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or use the service in a way that risks harm to others or to the service. Sections that by their nature should survive termination (ownership, disclaimers, liability, indemnification) will survive.

Mandatory consumer-protection law in your country of residence applies to you whatever these Terms say, and nothing here removes those rights. In particular, you have a 14-day right of withdrawal, explained in our Refund Policy, and you may bring proceedings in the courts of your own country. The European Commission also operates an online dispute-resolution platform for consumer disputes.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and notify account holders by email before the changes take effect. Your continued use of the service after that means you accept the updated Terms; if you do not, you may cancel.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The courts located in that jurisdiction will have exclusive jurisdiction over disputes, except where mandatory consumer-protection law entitles you to bring proceedings elsewhere.
