Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Erudizio, a guided AI-assisted ebook creation studio operated by [REGISTERED LEGAL ENTITY NAME & FORM — e.g. Smartmind Innovations LLC] (“Smartmind Innovations”, “we”, “us”, or “our”). By creating an account or using Erudizio, you agree to these Terms. If you do not agree, do not use the service.

1. Who can use Erudizio

You must be at least 18 years old and able to form a binding contract to use Erudizio. By using the service you confirm that the information you provide is accurate and that you will keep it up to date. If you use Erudizio on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. What Erudizio does

Erudizio helps you turn an idea into a finished ebook. It guides you through planning, writing, review, cover and interior design, and delivery of a “Launch Kit” (a PDF, an editable DOCX, a cover image, and marketing copy). Parts of the service use third-party artificial-intelligence models to generate text and images based on the inputs you provide.

3. Your account

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at support@erudizio.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Plans, credits, and billing

  • The unit you buy is a finished ebook, not an AI operation. Subscriptions (Starter, Pro, Studio) grant a monthly allowance of ebooks; one-time packs grant a single ebook.
  • One credit is charged per ebook, once, at the moment you approve its plan — the point of commitment before the main generation work. Abandoning at the idea or plan stage is free.
  • Failed generations are never charged. If a generation does not complete, you are not billed a credit for it.
  • Regenerations are free to you, subject to a reasonable internal fair-use limit so the service stays sustainable for everyone. If you ever reach it, contact us and we will help.
  • Monthly allowances do not roll over; one-time packs do not expire.
  • Subscriptions renew automatically each billing period (monthly or annually) until cancelled. Prices are shown at checkout. Taxes may apply depending on your location.

Payments are processed by our payment provider, Stripe. Cancellations and refunds are governed by our Refund Policy.

5. AI-generated content and your responsibility

Erudizio produces content using automated AI systems. AI output can be inaccurate, incomplete, or unsuitable for a given purpose, and may occasionally resemble existing material. You are responsible for reviewing, editing, and validating everything you generate before you publish, sell, or otherwise rely on it.

Fitness and health content: Erudizio is used to create fitness and wellness material. Nothing it generates is medical advice, and it is not a substitute for a qualified professional. You are responsible for ensuring your ebooks are safe, accurate, appropriately disclaimed, and compliant with the laws and advertising rules that apply to you and your audience.

6. Acceptable use

You agree not to use Erudizio to:

  • create content that is unlawful, defamatory, infringing, hateful, or that promotes harm;
  • generate dangerous or misleading health, medical, or nutritional claims;
  • infringe anyone’s intellectual-property, privacy, or other rights;
  • attempt to reverse-engineer, disrupt, overload, or gain unauthorized access to the service or its underlying systems;
  • resell, sublicense, or provide the service itself to third parties except as expressly permitted.

7. Ownership of your content

As between you and us, you own the ebooks and other output you create with Erudizio, including the right to sell, distribute, print, and use them commercially, with no royalties owed to us. You retain ownership of the ideas, text, and materials you submit (“Your Content”).

You grant us a limited, worldwide, non-exclusive licence to host, process, and transmit Your Content solely to operate and provide the service (including sending it to the AI and infrastructure providers described in our Privacy Policy). To the extent AI output can be owned, we assign to you whatever rights we may have in the output you generate.

8. Our intellectual property

The Erudizio platform, software, design, branding, and documentation are owned by Smartmind Innovations and its licensors and are protected by intellectual-property laws. These Terms do not grant you any right in our brand or platform beyond the right to use the service as intended.

9. Third-party services

Erudizio relies on third-party providers, including AI model providers (such as OpenAI), payment processing (Stripe), cloud hosting and storage (such as Amazon Web Services), and email delivery. Your use of the service is also subject to those providers’ terms where applicable. We are not responsible for third-party services we do not control.

10. Service availability

We work to keep Erudizio available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. We may also enforce reasonable technical limits (for example, on plan length, images per chapter, and regeneration usage) to keep the service sustainable.

11. Disclaimer of warranties

To the maximum extent permitted by law, Erudizio is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, non-infringement, and the accuracy or reliability of AI-generated content.

12. Limitation of liability

To the maximum extent permitted by law, Smartmind Innovations will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Smartmind Innovations from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your ebooks, or your breach of these Terms or of applicable law.

14. Termination

You may stop using Erudizio and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or use the service in a way that risks harm to others or to the service. Sections that by their nature should survive termination (ownership, disclaimers, liability, indemnification) will survive.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the service after changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of [GOVERNING LAW & JURISDICTION — e.g. State of Delaware, USA], without regard to its conflict-of-laws rules. The courts located in that jurisdiction will have exclusive jurisdiction over disputes, except where mandatory consumer-protection law entitles you to bring proceedings elsewhere.
